1. Agreement to Terms

By accessing or using SimVector (the "Service"), operated by Cardinal Horizon ("we," "us," or "our"), you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Cardinal Horizon. If you are accessing the Service on behalf of a company or legal entity, you represent that you have the authority to bind such entity to these terms.

2. Scope of Service & Intended Use

SimVector provides aeronautical data products, including but not limited to schedule data and navigation datasets. The Service is intended exclusively for Flight Simulation Entertainment Use.

  • Home Flight Simulation: Personal use by individual enthusiasts and non-profit Virtual Airlines (VAs) and their members.
  • Professional Simulation: Use within training environments or flight schools where the simulation is for educational or entertainment purposes and is not part of a certified pilot licensing curriculum.

3. Classification of Use & Licensing

To ensure the sustainability of our data warehouse, SimVector classifies usage into the following categories:

  • Personal Home Use: Access granted to individuals for private, non-commercial entertainment. This includes Virtual Airline members utilizing data for their community flights.
  • Commercial & Professional Use: Any use of SimVector data within a platform that generates revenue, operates on a subscription model, or is utilized within a professional flight training center. Commercial use requires a separate, written Commercial License Agreement.
  • Certified & Real-World Use (Prohibited): SimVector data is not licensed for use in any FAA/EASA (or equivalent) certified Flight Training Device (FTD), full-motion simulator used for official certification, or any real-world aircraft.

4. Aeronautical Data Disclaimer

SimVector datasets are not certified for real-world aviation or navigation. The data is provided "as is" for simulated environments only. You are strictly prohibited from using SimVector data for actual air navigation or in any environment where safety-of-life is at risk. Cardinal Horizon assumes no liability for damages, legal action, or incidents resulting from the use of this data outside of the scope of flight simulation entertainment.

5. Intellectual Property & Third-Party Data

SimVector distinguishes between the data you provide and the datasets our Service generates from that information.

  • Source Data: You retain all ownership, right, title, and interest in the raw data, files, or information you upload to the Service ("Source Data"). Unless otherwise stated, any data sourced from the platform, and/or purchased from the "SimVector Marketplace", remains the property of Cardinal Horizon and is licensed to you under the terms of that specific transaction or this Agreement.
  • User Responsibility: You represent and warrant that you have the necessary rights and permissions to upload and process your Source Data. You agree not to upload data that infringes on the intellectual property rights of any third party.
  • Derivative Data: As part of the Service, SimVector may process, transform, or analyze your Source Data to generate new datasets, formats (such as ARINC 424 or AIXM exports), or structural improvements ("Derivative Data"). The underlying proprietary logic, algorithms, and formatting structures used to create Derivative Data remain the exclusive property of Cardinal Horizon.
  • Aggregated & Anonymized Data: You grant Cardinal Horizon a perpetual, irrevocable license to use anonymized and aggregated data derived from your usage of the Service. This data is stripped of all personal and tenant-specific identifiers and is used solely to improve our data processing engines, optimize warehouse performance, and generate global industry insights.
  • Third-Party Data: SimVector may utilize or redistribute data owned by third-party licensors (such as map tiles, terrain models, or source aeronautical feeds). Your use of such data is subject to the respective third-party license terms.
  • Restrictions: You may not scrape, redistribute, or resell SimVector data or API outputs without an explicit commercial agreement.

6. Account Management & API Policy

  • Security: You are responsible for safeguarding your API keys and login credentials.
  • Fair Use: We reserve the right to monitor data throughput. Excessive usage that threatens the stability of the Service may result in temporary throttling or account suspension.
  • Integrity: Any attempt to reverse-engineer our data formats or bypass access controls is a violation of these terms.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Cardinal Horizon shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits or data, arising out of the use or inability to use the Service. While we strive for professional-grade accuracy in our datasets, we do not warrant that the Service will be uninterrupted or error-free.

8. Indemnification

You agree to indemnify and hold harmless Cardinal Horizon from any claims, damages, or expenses (including legal fees) arising from your breach of these terms or your use of SimVector data in a prohibited real-world or certified aviation context.

9. Governing Law & Jurisdiction

These terms and any disputes arising from them are governed by the laws of Japan. You agree that the courts of Kanagawa Prefecture, Japan, shall have exclusive jurisdiction over any legal proceedings related to these terms.

10. Modifications to Service

We reserve the right to update these terms to reflect changes in our data products or legal requirements. Continued use of SimVector following the posting of updated terms constitutes your acceptance of those changes.
